Who Can Apply for the Empire State Child Credit?

The credit is available to individuals who were residents of New York State for the entire tax year. In addition, they must have at least one qualifying child under the age of 17 at the end of the year for which the credit is claimed.

If federal adjusted gross income exceeds certain limits, the credit amount begins to phase out gradually. The reduction is $16.50 for every $1,000 over the applicable threshold.

The New York State Department of Taxation and Finance confirmed that the program expanded its benefit amounts to reach more taxpayers. It is a refundable credit, meaning it can be received even if no taxes are owed.

To access the benefit, filing a New York State tax return is required, along with submitting Form IT-213, the official application for the Empire State Child Tax Credit.

How Much Money Can You Receive Per Child?

For the 2025 tax year, the benefit establishes two different amounts based on the child’s age.

Children under four years old may generate a credit of up to $1,000 per child.

For children between ages four and 16, the credit is $330 for the 2025 tax year. This amount will increase in future years.

Starting in 2026 and 2027, the credit will be adjusted again to benefit more families. Children under four will continue to qualify for the $1,000 credit.

However, children between four and 16 years old will be eligible for up to $500 per child. This increase aims to reflect the real costs of raising children in New York State.

Identification Requirements and Use of an ITIN

To claim the credit, having a valid identification number is mandatory. This can be a Social Security Number (SSN) or an Individual Taxpayer Identification Number (ITIN).

Both the taxpayer and each child listed on the form must have one of these numbers. Without this information, the application will not be processed.

Individuals who file taxes using an ITIN are also eligible for this state credit. This represents a key difference compared to certain federal benefits.

The tax department reminds filers that the ITIN must be current at the time the return is submitted. If it has expired, it must be renewed in advance to avoid delays or denial.

Differences Between the State and Federal Child Tax Credits

The Empire State Child Tax Credit does not function the same way as the federal credit. New York uses a different calculation based on recalculated federal adjusted gross income.

Generally, the state credit equals 33% of the federal child tax credit and the additional child tax credit. However, the state chose to decouple from certain recent federal changes.

This means some families may qualify at the state level even if they do not qualify federally—a key advantage for low- and middle-income households.
