Special Counsel Jack Smith has requested a federal court this Wednesday to halt the appeal in the case against former President Donald Trump, who is accused of mishandling classified documents.

In a motion to the Eleventh Circuit Court of Appeals, based in Atlanta, Georgia, Smith requested the suspension of the appeal he filed against the decision of Federal Judge Aileen Cannon, who had dismissed the charge against Trump, now the president-elect.

Smith’s team had charged the former Republican president with improperly retaining confidential documents at Mar-a-Lago, his residence in Palm Beach, Florida, after leaving the White House in 2021.

Trump pleaded not guilty in this case, which also involves Waltine Nauta and Carlos de Oliveira, his personal assistant and the manager of Mar-a-Lago, respectively.

This suspension request is in addition to a similar one that Smith made last week in a Washington court, in a case where the former president is accused of electoral interference.

Simultaneously, U.S. media reported this Wednesday that Smith plans to resign before Trump assumes the presidency again on January 20.

Sources close to the prosecutor claim that his entire team, which depends on Attorney General Merrick Garland, would also resign along with Smith.

The special prosecutor’s early resignation is due to the high likelihood of being dismissed by Trump, who has publicly declared that he would fire him «in two seconds» upon taking office.

This case has generated great expectation in the United States, as the Department of Justice has never prosecuted former presidents, and the Supreme Court resolved in July that Trump has «absolute immunity» for his actions while in office.

The decision of the highest court left doubts about the scope of this immunity and how it might impact the cases Smith investigates.

The initial charges against Trump in this case date back to his management of classified documents at Mar-a-Lago, which, according to authorities, were kept irregularly after his term.

The alleged retention of these documents at his Florida residence has generated significant controversy since Trump left the White House in January 2021.

Trump’s Case Months Before Returning to Presidency

Despite the accusations, Trump has vehemently denied any wrongdoing and has argued that the documents in his possession were managed according to his presidential powers.

The indictment also includes charges of obstruction, which would exacerbate his legal situation in this case that has captured public and media attention.

Several judicial decisions have marked the case, with Judge Cannon dismissing the accusation in a move that Smith’s team immediately appealed.

However, with Wednesday’s request, Smith seems to be seeking to halt the appeal process in light of Trump’s imminent inauguration and the possibility that his case may be abandoned under the new administration.
